Mumbai : The sessions court, trying Kannada actress Maria Susairaj and her naval officer boyfriend Emile Jerome, has asked the prosecution to file a detailed reply if the case falls under the purview of Court Martial Rules and whether it should be tried separately according to the special provision available under section 475 of the CrPC.
Under Section 475 of the Criminal Procedure Code, the magistrate decides the jurisdiction of the court in which army, navy and air force personnel may be tried. The magistrate, if deems fit, can “deliver” the accused to the respective commanding officer for the purpose of court-martial proceedings.
The query was raised after Additional Sessions Judge, CA Jadhav read newspaper articles on a Bombay high court case in which a trial and the conviction was set aside in a 1985 murder case where a navy officer, Kanwarsingh Bedi, shot at two of his colleagues.
“The judge wants to be sure before taking the proceedings forward,” said Public Prosecutor, RV Kini. The case has been adjourned till Wednesday when both sides are expected to file detailed replies.
